Real Estate
The Burns, Figa & Will real estate practice encompasses both transactions and real estate litigation. Firm attorneys are experienced in representing property owners in resolving real estate disputes with their neighbors, governmental entities or lenders. Particularly, with neighborhood disputes, the firm makes every attempt to negotiate settlements but, failing that, is prepared to go to court to resolve the issues.
One area of emphasis is easements; including proving access to reach otherwise isolated properties or defending against claims of easements across our clients’ properties. Other issues in which the firm is frequently involved include boundary disputes, adverse possession claims, fence line issues, and title problems.
The firm represents insureds under policies issued by most of the nationally recognized title insurance companies. In addition, our attorneys are experienced in mechanics’ liens and judicial and public trustee foreclosure matters.
Burns, Figa & Will represents developers, investors, lenders, and business users in the acquisition, development, financing, sale and leasing of real estate. We carefully consider the needs of every client from small to nationally-based real estate developer, contractor or institutional lender to local entrepreneurs with an idea and a project.
Our attorneys are familiar with taxation of real estate, zoning and the regulation of land use. We frequently assist in planning the structure of and negotiating complex real estate transactions, as well as handling the legal analysis and documentation. Routine issues of subordination, non-disturbance, assignment, subletting and landlord liens become critical when the transaction starts to unravel and parties are forced to protect their interests. The firm’s real estate practice encompasses the preparation, negotiation and review of documentation relating to all aspects of commercial, industrial and residential acquisition and development, leasing, commercial lending, including real estate workouts and zoning and land use.
